Terms of Service

Please read these terms carefully before using our web development services.

1. Acceptance of Terms

By accessing and using WOSAG's web development services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

WOSAG provides web development, mobile app development, SaaS development, UI/UX design, and related digital services. Our services include but are not limited to:

  • Custom website development and design
  • Mobile application development (iOS and Android)
  • E-commerce platform development
  • Software as a Service (SaaS) solutions
  • UI/UX design and consultation
  • Digital marketing and SEO services
  • Technical support and maintenance

3. Service Agreement

All services are provided under a separate service agreement that will be executed between WOSAG and the client. The terms of this service agreement will supersede these general terms where applicable.

4. Payment Terms

Payment terms will be specified in the individual service agreement. Generally:

  • Payment schedules will be agreed upon before project commencement
  • Invoices are due within 30 days of receipt unless otherwise specified
  • Late payments may incur additional charges
  • All prices are in Indian Rupees (INR) unless otherwise stated
  • Refunds are subject to the terms of the specific service agreement

5. Intellectual Property Rights

Unless otherwise specified in the service agreement:

  • All custom code, designs, and content created for the client will be owned by the client upon full payment
  • WOSAG retains rights to any pre-existing intellectual property used in the project
  • Open-source components used in projects remain under their respective licenses
  • Client is responsible for ensuring they have rights to any content they provide

6. Client Responsibilities

Clients are responsible for:

  • Providing accurate and complete project requirements
  • Timely provision of content, images, and other materials
  • Reviewing and approving deliverables within agreed timeframes
  • Providing necessary access to systems and accounts
  • Complying with all applicable laws and regulations

7. Project Timeline and Delays

Project timelines are estimates based on the information provided at the time of agreement. Delays may occur due to:

  • Changes in project scope or requirements
  • Delays in client feedback or approvals
  • Third-party dependencies or integrations
  • Technical challenges beyond our control

8. Warranty and Support

WOSAG provides a limited warranty on our development services:

  • 90-day warranty on bug fixes for delivered projects
  • Support for issues arising from our code, not third-party integrations
  • Warranty does not cover changes in requirements or client modifications
  • Extended support available under separate maintenance agreements

9. Limitation of Liability

WOSAG's liability is limited to the total amount paid for the specific service. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Issues arising from third-party services or integrations
  • Client's failure to follow our recommendations

10. Confidentiality

WOSAG maintains strict confidentiality regarding client information and projects. We will not disclose confidential information to third parties without written consent, except as required by law.

11. Termination

Either party may terminate the service agreement with written notice. Upon termination:

  • Client will pay for all work completed up to the termination date
  • WOSAG will deliver all completed work and materials
  • Confidentiality obligations will continue to apply
  • Intellectual property rights will be transferred as per the agreement

12. Force Majeure

WOSAG shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, or government actions.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Calicut, Kerala.

14. Changes to Terms

WOSAG reserves the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of the modified terms.
